Late RTI Activist Amit Jethwa’s PIL Disposed

11 February 2011 5 Comments

The  Gujarat High Court today disposed of the PIL filed by RTI Activist Amit Jethva, who was shot dead last year and also Appreciated the steps taken by the government to check illegal mining in the state.

The division bench of two chief justice’s SJ Mukhopadhaya and justice Akil Kureshi appreciated the decision to form special task forces and grievance redressal committees to curb illegal mining.

Court accepted the government’s contention that the mechanism to check illegal mining activities are now in place and action is being taken against those violating the norms.

Amit Jethva’s PIL  had specifically drawn attention to the illegal mining in the Gir forest region. He was shot dead opposite the High Court building on July 20, 2010, a few days after filing the PIL.

During the last hearing, the state government had filed an affidavit stating it had formed special task forces and grievance redressal committees at state and district levels, and had said that it would hold police officers, revenue officers and officers of Geology and Mining department of the concerned area accountable for illegal mining activities.

The state government also told the High Court that a round-the-clock control room had been set up to receive complaints about illegal mining. Besides, informers are being given a cash reward.

After Jethva”s death, the court had made his younger brother Bhavani and uncle Vijay Rathod the petitioners.

RTI activist”s Amit Jethwa’s death had sparked off a political controversy, with Jethva”s father Bhikalal Jethva alleging that BJP MP from Junagadh, Dinu Solanki, was behind the murder.Bhikalal has also filed a petition in the High Court demanding investigation into his son”s death by the CBI or any other independent agency. The Ahmedabad crime branch, which was probing Jethva”s murder, had arrested six persons including Pratap alias Shiva Solanki, a nephew of Dinu Solanki.

Finally the Government is waking up !! as our first CIC Wajahat Habibullah said recently that the attacks and killings of RTI Activist’s proves that the Democratic machinery is now afraid of RTI’s being filed…but some one needs to ask him,the Martyrs who have laid down their life fighting Injustice, what have their families got…Just the name… rest is History.

Indiscriminate attacks on civilians ought, under all circumstances, to be illegal in war as in peacetime.
