RTI Activist Prashant Uikey States : Housing Society Members’ Toolbox For Opposing Crooked Redevelopers

RTI Activist Prashant Uikey ( prashant.vikey@gmail.com ) has compiled and sent Krishnaraj Rao, a sort of comprehensive guide and tool-kit to help those who are fighting to preserve their life and liberty being encroached by profiteering redevelopers, Which is being shared for everyone’s knowledge by him.

Prashant writes: “As many of you have experienced, the main center of corruption in any Redevelopment scam is the managing committee of the housing society that has opted for redevelopment. The municipal authorities and others play a secondary role. In most of the cases, managing committee members betray the trust of the society members by unduly favoring the Developer/Builder. They sell away the bargaining points of the society for money.

“We have all the favorable rules and laws in place, but lack of implementation is the main cause of corruption plaguing our society.

“On 3rd January 2009, Govt of Maharashtra’s Co-operation Department issued strict guidelines for redevelopment. This is contained in Circular No. CHS 2007/CR554/14-C. It contains a Directive under Section 79(A) of Maharashtra Co-operative Societies Act 1960 for Housing Societies in Maharashtra regarding procedures and safeguards to be followed by societies seeking redevelopment. Corrupt managing committees who collude with builders to cheat their society members usually violate these guidelines.

“Those who are troubled by unlawful redevelopment can try and stop the process by exposing breach of guidelines, and filing complaints against against such breaches. You can frame your RTI questions in a way that can expose the scam. I have attached my RTI application to the concerned department for your reference.

“Besides getting information, these questions are designed to force the concerned authorities to take action against any irregularities,” said Prashant.

“Distribute copies of these Maharashtra SIC orders to silence those who argue that Cooperative Societies are not under the ambit of the RTI Act,” Prashant advised. And he ended with a quote: “Defeat is not final when you fall down. It is final when you refuse to get up.”
