Rajiv Gandhi’s Killers Get A Reprive From Madras High Court

30 August 2011 No Comment

Rajiv Gandhi’s assassins got a reprive from Madras High Court On Grounds of Delay of 11 years, the high court has stayed their sentence of hanging the 3 convicts on 9th September and given a 8 weeks reprive by giving a interim stay, just because the Presidents office took 11 years on rejecting their mercy petition, the counsel for the assassins Ramjethmalani has said that the High court has done justice.

The assassins Murugan, Santhan and Perarivalan are charged for the assassination of Rajiv Gandhi, Tamilnadu Government has adopted a resolution for reviewing of the sentence and has asked the President to intervene and reconsider the mercy plea.

Many experts have felt that Mercy disposals and execution of death sentences are beyond judicial purview, A fresh plea for lenient sentence cannot be moved  by the accused either before a governor, CM or a high court  as they don’t have the jurisdiction to take up a matter which can change either the apex court ruling or a decision taken by the President, so the relief is just a delay legally.
